A man who took the drug Nexium in 2014 after it was found to have no ulcers or bleeding in his stomach, was sentenced today in U. S. District Court in Philadelphia. The case was brought by the plaintiff, Mark B. Johnson, who took the drug for the first time in 2006, after the Food and Drug Administration approved the drug for the treatment of heartburn. In January 2013, Johnson's condition had worsened and his doctor, Dr. William R. Stapleton, began prescribing the drug in an effort to manage his condition and prevent ulcers from returning.

Johnson was diagnosed with heartburn on May 22, 2011, at age 60 and suffered two stomach ulcers on June 27, 2011. After the ulcers resolved on July 8, 2011, he took Nexium at the same time, for a second time, on July 29, 2011. On August 7, 2011, Johnson was hospitalized for stomach ulcers, after suffering a heart attack and a stroke.

Dr. Stapleton, who treated Johnson for the ulcers, has stated that he was not aware of any connection between the ulcers and the use of Nexium.

Johnson has also been ordered to pay a fine of $3,000 per year and a separate case is pending in the U. District Court for the Eastern District of Pennsylvania.

Johnson was sentenced today in Philadelphia to 12 months in federal prison after he received the drug for the first time in 2006, the first time in 20 years. Johnson was sentenced by U. District Judge Richard B. Stapleton to 12 months in federal prison.

The plaintiff, Mark B. Johnson, had taken Nexium, an over the counter medication, for years, and developed ulcers when he began taking the drug on May 22, 2011, in his stomach. In April 2012, the plaintiff reported that the ulcers would not heal and that he was taking an over the counter medication called Pepcid. Johnson's condition worsened and he began taking the over the counter medication, Pepcid, on July 8, 2011. A doctor prescribed Pepcid on August 7, 2011, and the ulcers resolved on August 11, 2011. On August 11, 2011, the plaintiff was taken to an emergency room where he was given a prescription for Pepcid. On August 10, 2011, the plaintiff was hospitalized for a stomach ulcer and he suffered an ulcer that was not healing. In his statement, the plaintiff explained that he had to take over the counter medication, Pepcid and that he had suffered the ulcer from the time he took the over the counter medication. He stated that he had never experienced such a long-term condition.

The plaintiff is a 57-year-old resident of Philadelphia and lives in South Philadelphia.
